The last Will and Testament of Francis Tanner Carpenter of Colerne in the County of Wilts. I Francis Tanner being of sound disposing mind and memory do make this my last Will and Testament in manner following First I give and bequeath unto my wife Florida Tanner for and during her natural life all the rents interest money and all profits whatsoever arising from my Houses Lands and Insurances for life with all my Personal Property in the parish of Colerne and wheresoever the said property may be found to her my said wife Florida Tanner for own special use during the term of her natural life after my wifes decease I give and bequeath unto my oldest son Charles Tanner and to my youngest son Giles Tanner all my Dwellinghouse Garden Yards with all the premises thereunto belonging with Ingress & Egress & rights and titles thereunto belonging to be equally divided between them situate in Colerne aforesaid I also give and bequeath unto my son William Tanner all my three several cottages in Tuttenhill occupied by William Allen George Hemmings Matthew Smith with the Gardens and premises thereunto belonging in Colerne aforesaid I also give the Blacksmiths Shop adjoining my dwelling house to my Son William Tanner with the liberty to enlarge the same at his own discretion down to the first post of the Carpenters Shop also I give to my son William Tanner all the Smiths Tools in the Blacksmiths Shop for his own use I also give and bequeath to my son Awbrey Tanner the remaining three Cottages in Tuttenhill occupiers Charles Tanner James Johnson and John Hemmings also a Cottage occupied by Joseph Wilton in Totts Lane in Colerne.
I also give and bequeath to my Son George Tanner all my Cottage Garden & a close of paddock belonging with all its premises thereunto belonging situate at Thickwood in the parish of Colerne in occupation of my Son William Tanner I also give and bequeath to my Daughter Jane Tanner two of my Cottages situate at Thickwood in the parish of Colerne now in occupation of William Nathan & Thomas Hillier I also give and bequeath to my daughter Mary Tanner my other two cottages situate at Thickwood in the parish of Colerne in occupation Henry Woodward and Betty Tops with the Gardens & I also give and bequeath unto my Son Edmund Tanner Field at Thickwood known by the name of Well Grove with rights and titles with Ingress & Egress to the same I also at my decease after my wifes decease give to my Son Edmund Tanner all my Horses Wagons Carts Harrows Ploughs with all the Farming Implements whatsoever & wheresoever I also give to my Son Edmund Tanner my two my two daughters Jane and Mary Tanner all my Household Furniture equally divided between them with the exception of the Grates Boilers and all the Fixtures which is not to be moved I direct that my two sons Charles and Giles Tanner are appointed my two sole Executors of this my last will and Testament which I do make declare revoking all other wills which I do hereunto set my hand and seal this twentieth day of April in the year of our Lord one thousand eight hundred and forty seven Francis Tanner (SS) Signed sealed and declared to be the last will and Testament of the said Testator Francis Tanner which he hath signed in the presence of us three witnesses who have signed our names individually and each one for himself have set our seals & signatures severally and individually George Drewett George Wheatland Isaac Chandler

Appeared Personally George Drewett of Colerne in the County of Wilts Baker and made oath that he is one of the subscribed witnesses to the execution of the last will and Testament of Francis Tanner late of the parish of Colerne in the County of Wilts deceased the said will bearing date the twentieth day of April in the year of our Lord one thousand eight hundred and forty seven and being now thereunto annexed and the deponent further made Oath that on the said twentieth day of April the said Testator duly executed his said will by signing his name at the foot or end thereof as the same now appears in the presence of the deponent and of George Wheatland and Isaac Chandler the other subscribed witnesses thereto all of whom were present at the same time and that the the deponent and the said George Wheatland and Isaac Chandler thereupon attested and subscribed the said will as witnesses to the due execution thereof in the presence of the said Francis Tanner the Testator deceased. This is the last Will and Testament of me Florida Tanner of the Parish of Colerne in the County of Wilts Widow of the late Francis Tanner of the said Parish Carpenter deceased First I direct that all my just debts funeral and testamentary expenses and the costs of proving this my Will be paid as soon after my decease as conveniently can be I give and so bequeath to my Son Awbrey Tanner all that my Cottage or tenement with a Garden thereto belonging situate in the Parish of Colerne aforesaid and now in the occupation of Joseph Wilton To hold unto my said Son Awbrey his heirs and assigns for ever I also give and bequeath to Daughter Jane Tanner all those my two Cottages with the Gardens belonging thereto as divided off situate lying and being at Thickwood in the Parish of Colerne aforesaid and now in the several occupations of William Nathan and Thomas Hillier To hold to her my said Daughter her heirs and assigns for ever I also give and bequeath to my Daughter Mary Tanner all those my other two Cottages with the Gardens adjoining thereto as divided off situate lying and being at Thickwood aforesaid and now in the several occupations of Henry Woodward and Betty Tops to hold to her my said Daughter her heirs and assigns for ever I also give and bequeath unto my Son Edmund Tanner a field at Thickwood aforesaid commonly called or known by the name of Well Grove or Hill Grove together with all rights members and appurtenances thereto belonging To hold to him my said Son Edmund his heirs and assigns forever I give and bequeath all rents that may be in arrear at the time of my decease and all the rest residue and remainder of my goods chattels and effects both real and personal unto and equally between my said two Daughters and their Brother Edmund their heirs executors administrators and assigns equally to be divided between them as tenants in common and not as joint tenants and I appoint my said Son Aubrey Tanner Executor of this my last Will and Testament hereby revoking all other Wills by me at any time heretofore made In witnefs whereof I the said Florida Tanner have to this my last Will and Testament set my hand this twelth day of January One thousand eight hundred and forty eight.

On the thirtieth day of September 1858 Letters of Administration with the will thereto annexed of all and singular the personal Estate and Effects of Florida Tanner late of Colerne in the County of Wilts Widow deceased who died on the thirty first day of December 1857 at Colerne aforesaid having a fixed place of abode at the same place were granted at the District Registry attached to Her Majesty’s Court of Probate at Bristol to Jane Tanner of Colerne aforesaid Spinster (Daughter of the deceased) one of the Residuary Legatees named in the said Will she having been first sworn duly to administer Aubrey Tanner the sole Executor named in the said Will having died without proving the same

This Receipt is perfectly evince as regard the successor though it clears the duty. Charles Tanner was not entitled to the one third under Florida Tanners Will The 2 cottages passed under the residuary devise to Jane Tanner and Edmund Tanner who subsequently both ….ccepted their Interests which became ultimately vested with Mr Giles Tanner
